Terms of trade

These terms apply to quotes issued and work performed by ASAP Rigging (ABN 53 846 076 199, "we", "us") unless a written contract says otherwise. Nothing in these terms limits any right you have under the Australian Consumer Law that cannot be excluded.

1. Quotes

• Quotes are in Australian dollars and exclude GST unless stated. GST is shown separately on quotes and tax invoices.
• A quote is valid for the period shown on it (30 days unless stated) and is based on the information supplied to us and the site conditions described.
• A quote is accepted when you confirm it in writing (email is fine) or instruct us to start work.

2. Scope and variations

• The quote describes the scope. Work outside that scope, changes to the program, additional site attendances, waiting time caused by others, and conditions not disclosed to us are variations.
• Variations are charged at the hourly and unit rates on the quote, or as agreed in writing before the work is done wherever practical.

3. Site, plant and permits

• Unless the quote says otherwise, you provide safe site access, lifting plant (cranes, telehandlers, EWPs), power, permits, engineering certification of items to be lifted and any exclusion zones required.
• We may stop or refuse work that cannot be done safely or lawfully. Time lost for that reason is not our cost.
• You will tell us about hazards on site before we start, including services, contaminated or unstable ground and structural conditions.

4. Payment

• Tax invoices are payable within 7 days of the invoice date unless the quote states other terms. Progress claims may be issued on longer jobs.
• Overdue accounts may be charged interest at 2% per month and reasonable recovery costs. We may suspend work while an account is overdue.
• Where the Building Industry Fairness (Security of Payment) Act 2017 (Qld) applies, our payment claims are made under that Act.

5. Cancellation

If a booked job is cancelled or postponed by you with less than 24 hours' notice, we may charge for crew time and costs already committed, up to the quoted day rate for the first day.

6. Insurance and liability

• We hold public liability insurance. Details are available on request.
• To the extent permitted by law, our liability for any claim is limited to re-performing the services or refunding the amount paid for them, and we are not liable for consequential loss such as delay costs or loss of profit.
• We are not responsible for defects in items supplied by others, engineering designs we did not prepare, or damage arising from information you gave us that was inaccurate.

7. Welding and fabrication

Welding is performed to the applicable Australian Standard for the work described. Where structural certification or inspection is required by your engineer or the project, that is arranged and paid for by you unless it is included in the quote.

8. Privacy

We handle your information as described in our privacy policy.

9. Law

These terms are governed by the law of Queensland, Australia.
